Pyrenees Puppy Purchase Contract and Spay/Netuer Agreement

Puppy, to the best of our knowledge, is in sound health. If, within 72 hours, pup is found to have a
serious health problem or disease, as confirmed by both the buyer's licensed veterinarian and our
licensed veterinarian, the pup may be returned to Kleine Farms for a replacement, as available, or
refund. The total liability of Kleine Farms is limited to the purchase price of the puppy minus the deposit.
If you choose to not bring the puppy in in the 72 hrs, no refunds shall be given.
Any dog found to have a genetic disorder that would prevent him from continuing as a companion
animal in his first year, and confirmed with the agreed diagnosis of both the buyer's and the seller's
veterinarians, shall be eligible to be returned for a replacement, as available, to Kleine Farms. If no
replacement will become available in a reasonable time period, a refund would be considered.
Covered faults must be of genetic origin, and not resulting from environmental factors, poor nutrition,
accidents, or illness incurred after the buyer has taken possession of the puppy. Reaction to
immunizations, heart murmurs and medications are not genetic faults. Kleine Farms will not be responsible for
medical bills incurred. If a refund is wanted for any reason, the puppy must be returned to Kleine Farms.
Buyer agrees to be solely responsible for this dog/puppy and to indemnify and hold harmless from any and all claims of liability for the conduct of this dog/puppy after the date of transfer from Kleine Farms.
If the buyer is unable to keep the above puppy/dog,the seller must be notified immediately. At the Kleine Farms discretion, the puppy/dog may be returned to Kleine Farms. With or Without refund depending on age. We will assist on finding a new home for the puppy/dog. The puppy/dog may not be sold, traded, given away, or given to any animal shelter or rescue organization without written consent from Kleine Farms. Buyer also agrees not to list the dog/puppy for sale, trade or give away on the internet or in the newspaper. If the dog/puppy is returned to the seller for ANY reason, all fees and shipping expenses will be paid for by the Buyer.
If Seller finds it necessary to reclaim the puppy/dog or any legal or lawsuits result from this contract, all costs and attorney fees associated with bringing and defending such litigation shall be born wholly and exclusively by the Buyer. The buyer agrees to any and all legal or court proceedings or cases resulting from this contract shall be filed and held only in Cottonwood County Courts located in Windom, Minnesota.

Spay/Neuter Agreement
Permanent ownership of this dog is contingent upon your compliance with this Addendum. Proof of the spay/neuter must be received by Kleine Farms within fourteen (14) days after the surgery. In the event that the dog’s health does not allow this agreement to be honored, Kleine Farms must be provided with a statement from your veterinarian that this dog is not yet in physical or emotional condition for surgery. Based upon the veterinarian’s evaluation of this dog the (purchaser) will contact the veterinarian and establish the earliest date that the procedure can be performed. (PURCHASER) will notify Kleine Farms of this amendment in writing, at which time all other conditions of this agreement will apply and be enforced.
This is the responsibility of the PURCHASER, not the veterinarian, to ensure that Kleine Farms has received verification that the surgery has been performed. Failure to comply with this agreement by the date below, unless otherwise agreed to in writing, will be considered a breach of the Contract, and PURCHASER will transport this dog back to Kleine Farms and will not be entitled to a refund.
By my signature below, I agree to have this dog spayed/neutered by no later than ___________, and I understand that this spay/neuter agreement is an agreement that this dog will not produce a litter of puppies either as purposely bred or by accidental breeding. I also agree that should puppy not be altered that I will return said puppy back to Kleine Farms with no refund. In the event of a breeding, the dog/bitch will be returned to us and all puppies born from any breeding, accidental or otherwise, will become the property of Kleine Farms.
